It doesn't give them that power, but so many think it does it is ridiculous.

I think some cities are going to have Executive Orders rammed down their throats as legislation during this time.

I have no doubt the socialists already in power will attempt to use this crises to consolidate the power they already have and leverage power they don't yet have. This weekend is when I expect more shelter in place orders and possibly martial law in some areas.

Wouldn't martial law require some legislative action over an EO? I'm fairly certain it does.

I'm also fairly certain that enforcing it will be about impossible.

Oh..it'll be very possible, with the public's enthusiastic help.
Idiots are already calling 911 if someone sneezes near them; they'll happily call to report 'neighbors' that go outside.

The idiotic enthusiasm is what worries me.

The cold, hard reality is that we, the populace as a whole, cannot stay within their homes for more than a week (maybe two in some areas). They simply do not have to food available to them. That and add to the fact that police forces will be overwhelmed by calls, it makes these things a joke.

Unless you live right on top of people, going in your backyard isn't going to infect your neighbor!

The way I understand it, Martial Law can be declared by either, and yes, it should be damn near impossible to enforce.


Martial law on the national level may be declared by Congress or the president. Under Article I, Section 8, Clause 15, of the Constitution, Congress has the power "[t]o provide for calling forth the Militia to execute the Laws of the Union, suppress insurrections and repel Invasions." Article II, Section 2, Clause 1, of the Constitution declares that "[t]he President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States." Neither constitutional provision includes a direct reference to martial law. However, the Supreme Court has interpreted both to allow the declaration of martial law by the president or Congress. On the state level, a governor may declare martial law within her or his own state. The power to do so usually is granted in the state constitution
